Seller Center- Security best practices

 

    1.  You can reinforce your password security in this way as you are required to enter an additional code from your phones when signing in to your account. This can greatly reduce the risk of unauthorised access if the password is compromised.

 

    1. Pick strong passwords that are different for each of your accounts and change your password regularly.
      • Choosing the same password for each of your online accounts is like using the same key to lock your home, car and office – if a criminal gains access to one, all of them are compromised.
      • Use a long password made up of numbers, letters and symbols.
      • Avoid using publicly-available information (For example: your phone number) in your passwords.

 

    1. Make sure that the email address or the mobile number that you use to sign-in to your account is up-to-date. For more information on how to change your email address or password.

 

    1. If your business has multiple users, then have each user set up their own account and then link your accounts. Ensure that you regularly review secondary users who have access to your account and revoke access to users who no longer need access.

 

  1. Review your Notification Settings and ensure that you have the required setup to receive notifications of important actions being taken on your account. Beware of phishing. Pezkart never asks you to verify sensitive information via email. Submit such information only when completing an order on our website, registering to sell on Pezkart or updating account information in Seller Center.

Condition Guidelines

 

The first step towards ensuring a great experience for both buyer and seller is an honest appraisal of the items you list for sale on Pezkart.com.

Please note: Once you have chosen the condition of your listing, you cannot modify it later.

Unacceptable and prohibited items

Items in any of the following conditions are unacceptable for listing on Pezkart:

  • Item is not clean, including signs of mold, heavy staining, or corrosion.
  • Item is damaged in a way that renders it difficult to use.
  • Item is missing essential accompanying material or parts. This does not necessarily include instructions.
  • Item requires repair or service.
  • Item was not created by the original manufacturer or copyright holder. This includes copies, counterfeits, replicas, and imitations.
  • Item was originally distributed as a promotional copy, promotional bundle, product sample, or advance reading copy. This includes uncorrected proofs of in-print or not-yet-published books.
  • Item has passed the expiration date (includes "best by" and "sell by" dates), has an unacceptable portion of its shelf life remaining, or the expiration date has been tampered with or removed.
  • Item was intended for destruction or disposal or otherwise designated as unsellable by the manufacturer or a supplier, vendor, or retailer.
  • Item is prohibited for sale on Pezkart.

 

 

 

Books

We suggest that you list books at a price lower than the pezkart.com price.

Collectible books

Must be signed, a limited first edition, out of print or have other desirable qualities that could reasonably be assumed to increase the book's value to a collector--you will have an opportunity to say why your copy is collectible. We suggest that you list such books at a price higher than the Pezkart.com price.

New books

Brand-new, unused, unread and in perfect condition. Books with markings of any kind on the cover or pages, books marked as "Bargain" or "Remainder," or with any other labels attached, may not be listed as New condition.

What we will not accept for sale at Pezkart.com: mouldy, badly stained or unclean copies; copies with missing pages or obscured text; promotional books, including advance reading copies. Uncorrected proof copies are prohibited.

Make sure you describe your books in an accurate manner. An accurate product description increases buyer satisfaction, helps sellers build a loyal customer base, and ensures positive feedback ratings. The presence of a remainder mark should always be noted in comments. Advance reading copies and uncorrected proofs are not permitted.

Electronics & Photo

New Electronics & Photo items

A brand-new, unused and unopened item in the original packaging with all of the original packaging materials included. The original manufacturer's warranty, if any, should still apply, with details of any such warranty included when you complete the Add your comments section of the product listing.

What we will not accept for sale at Pezkart.com: electrical and photographic items that do not work perfectly in every regard or are damaged in ways that render them difficult to use. Items not manufactured or printed by the original manufacturer. Electrical items without CE marks are not acceptable.

All electrical and photographic equipment must be safe (that is, there is no risk that the equipment will cause death, personal injury or damage to property) and, where applicable, come fixed with an Indian standard plug. You must not list any product that has been the subject of a product safety recall.

 

Ink and Toner Cartridges

New Ink & Toner Cartridges

A brand-new, unused, unopened ink or toner cartridge in its original packaging and with all original packaging materials included. The original manufacturer's warranty, if any, still applies, with details of the warranty included in the comments on the item's condition.

 

Home & Kitchen

New Home & Kitchen items

A brand-new, unused and unopened item in the original packaging with all of the original packaging materials included. The original manufacturer's warranty, if any, should still apply, with details of any such warranty included when you complete the Add your comments section of the product listing.

What we will not accept for sale at Pezkart.com: Home & Kitchen items that do not work perfectly in every regard or are damaged in ways that render them difficult to use. Toys

We suggest that you list toys at a price below the Pezkart.com price.

Collectible toys

Must be unique--you will have an opportunity to detail why your toy is collectible. We suggest that you list such toys at a price greater than the Pezkart.com price.

New toys

A brand-new, unused, unopened toy, in perfect condition.

What we will not accept for sale at Pezkart.com: All toys must be safe (that is, there is no risk that the equipment will cause death, personal injury or damage to property). You must not list any product that has been the subject of a product safety recall.

In addition, promotional items are prohibited for sale through Pezkart.com.

 

Software

New software

Brand-new, unused, unopened software, in perfect condition.

What we will not accept for sale on Pezkart.com: Software that has been copied or duplicated in any format is prohibited. In addition, fulfilment, promotional, beta (pre-release), unauthorised freeware/shareware and softlifted software versions are prohibited. The majority of software licence agreements permit the initial licensee of the software to make a one-time permanent transfer of the licence directly to an end user.

Sometimes the licence requires the transfer to include all of the software product (including all component parts, the media and printed materials, any upgrades, the licence itself and, if applicable, the Certificate of Authenticity). You should refer to your software's licence agreement to ensure that any software posted for sale is permitted to be transferred. Software that is not usable, is incomplete or in breach of the licence agreement is unacceptable, as is software not published by the original manufacturer, including recopied media in any form.

 

Consumable, Ingestible, and/or Topical Products

 

Intellectual property for Rights Owner

 

Pezkart is dedicated to ensuring that products on its marketplaces do not violate or infringe a Rights Owner's intellectual property (IP) rights. Rights Owners can report infringing content they find on Pezkart and share answers to frequently asked questions on how Pezkart handles infringement complaints. A Rights Owner includes any person (such as a brand, a seller, a customer or any third party) who legitimately owns intellectual property rights for the product in question.

Note: The following information does not contain legal advice. You should consult a lawyer if you have specific questions about your IP rights or the IP rights of others.

If you are a Rights Owner with a registered trademark, you may be eligible to enroll your brand in the Pezkart Brand Registry. Pezkart Brand Registry provides access to powerful tools including proprietary text and image search, predictive automation based on your reports of suspected intellectual property rights violations, and increased authority over product listings with your brand name.

 

 

 

Reporting Infringement

 

To submit a notice of IP infringement, you must be the Rights Owner who owns the IP being reported or an agent with permission from the Rights Owner to submit notices on his or her behalf. Do not forget to provide your contact details (name, address, phone number, email address, secondary contact details) when you report infringement.

If your brand is enrolled in Pezkart Brand Registry, you can submit a report via the Report a Violation (RAV) tool or through our Report Infringement form. Rights Owners who do not have a brand enrolled in Pezkart Brand Registry can submit via the Report Infringement form. In addition, it is a requirement that a notice submitter be logged into an Pezkart account in order to use the Report Infringement form or Brand Registry's RAV tool. For India marketplace, the Grievance Officer can also be contacted via email to report infringement.

You can submit a trademark, copyright, patent, or other IP claim.

You should include the following information in your report:

  • Specific identification of the IP you believe is infringed: trademark, copyright, or patent registration number; written description of or link to copyrighted work; etc.
  • Nature of infringement (whether infringement occurs on the physical product, physical product packaging, image on the product detail page, or text on the product detail page).

 

 

 

 

Patent

 

A patent is a form of legal protection for inventions. An issued patent grants its owner the right to exclude others from making, using, offering to sell or selling the invention for a fixed number of years.

Utility patents, the most common kind of patent, can be granted for the following:

  • A new machine
  • Article of manufacture
  • Composition of matter, process, or improvement on both matter and process
  • Protects the structure and functions of a product (rather than how it looks)

A utility patent is different from a trademark in that it protects an invention (such as a new machine) rather than a word or logo used to identify the source of the product. A utility patent is different from a copyright in that it does not protect the expressive content of a creative work like a book or a picture, but instead protects a specific invention, such as a new method of printing books or a new type of camera.

Design patents are granted for the unique look of a product, but do not cover the functions of a product. In the United States, design patent numbers begin with the letter "D."

 

 

 

A. Trademark Infringement

 

Seller-Level Infringement: If you believe a particular offer from a Seller is listing a product that infringes your trademark, then you may report that offer as infringing. However, expect the product detail page and Product ID to remain live if you report an offer. When you report an offer, and not an entire Product ID , you are only referring to the offer for infringement, not the entire Product Id or product detail page. It is also helpful to provide a test buy with a valid Order ID to support your report.

Product detail page Infringement: If your trademark is being used on the product detail page, but the product being sold is not your product, you may report use of the trademark on the product detail page as infringing.

Important: If the trademark you are reporting is used to indicate compatibility with your product, we may reject your notice. Note: Counterfeit is a form of trademark infringement.

 

B. Copyright Infringement

Seller-Level Infringement: If you believe a particular offer from a Seller listing a product that infringes your copyright, then you may report that offer as infringing. However, expect the product detail page and Product ID to remain live if you report an offer. When you report an offer, and not an entire Product ID, you are only referring to the offer for infringement, not the entire Product ID or product detail page. It is also helpful to provide a test buy with a valid Order ID to support your report.

Image or Text Infringement: If your copyrighted image is used on a product detail page without your permission, then you may report the image as infringing. However, expect the product detail page and Product ID to remain live if you report an image or text. When you report an image or text, and not an entire Product ID, you are only referring to the image or text for infringement, not the entire Product ID or product detail page.

Patent Infringement

Design: If an Product ID or product on Pezkart is infringing your design patent, then you may report the entire Product ID. If we accept your report, we will remove the Product ID.

Utility: If an Product ID or product on Pezkart is infringing your utility patent, then you may report the entire Product ID. It is helpful to provide a court order or an International Trade Commission order finding infringement of the reported patent with your notice.

 

India does not have a distinction between design patents and utility patents. Evaluation of patent infringement may require a court order.

 

Notice not accepted on Pezkart

 

Exclusive Distribution, Direct Selling and Minimum Advertised Price (MAP) Agreements: Pezkart respects a manufacturer's right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the resellers, Pezkart does not assist in this type of enforcement activity. , unless specifically required under local law to do so.

Compatibility: Pezkart does not enforce notices seeking to remove true statements indicating compatibility with trademarked products. If a product detail page clearly and truthfully states the product being sold on that page is compatible with a trademarked product, Pezkart will not take action on a notice directed to the use of the trademarked term.

Parallel Import: Pezkart accepts notices directed to parallel import claims in certain kinds of infringement (such as copyright) in India.

 

If you are a brand enrolled in Pezkart Brand Registry, use the Report a Violation tool.

If your brand is not enrolled in Pezkart Brand Registry, then use our public-facing Report Infringement form.

 

Seller IDs and reporting infringement

 

If a seller's offers are infringing on your intellectual property or a product sold on Pezkart is infringing your intellectual property, you can use RAV or the Report Infringement form to report one of the following:

  1. All sellers listing on the Product ID (product)
  2. Specific sellers' offers

 

Once you have determined what Product IDs to report, the seller IDs are automatically populated in our systems by the Report Infringement form and RAV.

Both RAV and the Report Infringement form will auto-populate a list of sellers that are listing an Product ID or product detail page once you provide either an Product ID or URL. Select either ALL sellers or the Specific sellers option when submitting your report of intellectual property infringement.

 

Result from submitting a notice of infringement

 

You will receive a confirmation message that we are reviewing your notice. We will send you a follow up message once your notice has been processed.

If your notice is valid, we will inform the responsible sellers about your claim and share your secondary contact information with them should they have any follow-up questions.

Note: If your secondary contact information is not available, then we will share your primary contact information with the seller.

 

If your notice of infringement is accepted, we will remove the content you reported and take appropriate action against the responsible sellers. However, specific actions are confidential.

If your notice of infringement is rejected, we will not remove the content you reported and the seller will not be actioned.You will receive a notification with the reason for rejection of your notice.

Important: The continuous submission of inaccurate or fake notices could lead to the removal of your submission privileges.

 

Pezkart Seller Program - Terms & Conditions

 

1. INTRODUCTION

 

  1. The Pezkart Seller Program ("Program") is a program offered by Pezkart Online Shopping  Private Limited ("Pezkart") to sellers ("Sellers") on Pezkart.com ("Pezkart Marketplace"). This program is intended to reward Sellers that meaningfully contribute to the Pezkart India Marketplace by way of offering desirable selection of daily essential products for home delivery across categories including but not limited to grocery (including beauty, health and personal care), pharma, pet supplies, ready to eat meals and beverages, consumer electronics, home and kitchen products, soft lines and fashion accessories, jewelry and books and providing to the customers in a time bound manner through the Pezkart India Marketplace
  2. Any capitalised term used in these Pezkart Now Seller terms and conditions Terms and Conditions and not defined herein will have the same meaning as assigned to them under the Business Solutions Agreement.

2. ELIGIBILITY AND PERFORMANCE CRITERIA

 

  1. In order to enrol under the Program and ensure continued enrolment under the Program, the Seller is required to meet such eligibility criteria's as has been provided under Schedule 1 of these Terms and Conditions.
  2. Further, in order to avail the benefits of an enrolled Seller under the Program, the Seller is required to meet such performance criteria's as has been provided under Schedule 2 of these Terms and Conditions.
  3. A Seller's performance (in accordance with the performance criteria's) will be reviewed from time to time during the term of the Program.
  4. If at any point of time during the Seller's enrollment or participation under the Program, Pezkart determines in its sole and absolute discretion, that the Seller has not met the eligibility and/or performance criteria's. Pezkart reserves its right to terminate the Seller's enrollment under the Program or terminate the benefits of the Program, as the case may be, without prior notice; in which event while the Seller cannot avail benefits under the Program. However, the Seller may continue selling on the Pezkart Marketplace under the Business Solutions Agreement.

3. Pezkart NOW PROGRAM BENEFITS

3.1 Benefits

Under the Program, the Seller will be eligible to avail the following benefits:

 

  1. Training and Support:

    Pezkart will provide the Seller such training and support for an initial period of 3 months, with a view to assist Sellers in understanding the use of Pezkart tools, respond to queries from Sellers and help in understanding the requirements of the Program. During the course of this support, the Seller will be responsible for managing its own account and Pezkart's involvement will be limited to assisting the Seller in understanding the Program and the use of Pezkart tools in relation to the same.

    Pezkart will further provide training to one of the personnel nominated by Seller from his store for handling operations of the store in relation to the Program. The Seller is responsible for ensuring that all other personnel who may need training for the purpose of the Program, be imparted training such nominated person, across shifts and locations.

  2. Onboarding Support: If required, the Seller may opt for receiving onboarding support to initially map the seller's store SKU's to Pezkart Product ID , however Pezkart will not be responsible or liable in any manner whatsoever for such mapping during the support period.

3.2 Hardware Device:

 

  1. As part of the Program and to help the Sellers process orders placed on Pezkart Marketplace, Pezkart will provide (as a one-timeoffering) certain hardware devices to the Seller under the service offerings at no extra cost.
  2. The Seller shall ensure safe custody of any such device provided by Pezkart for the performance under the Program and further beresponsible for any loss/damage caused to the same
  3. The Seller shall ensure that the device provided by Pezkart is strictly used for the purposes of Program and by its authorized personnelonly. Pezkart shall not be responsible in any manner whatsoever if there is any misuse of the device by the Seller and/or its employees

4. Pezkart NOW RETURN/ REFUND AND OTHER POLICIES

As part of the Program, the Seller will be required to adhere to:

 

  1. Pezkart return and refund policies as has been provided under Schedule 4 of the Terms and Conditions; and
  2. other Pezkart specific policies as may be provided by Pezkart in writing and/or through the Seller Center.
  3. Pezkart will provide 3 days return gurantee to our customer so seller will accept return 3 days after delivery.

5. DURATION & TERMINATION

 

  1. The term of the Seller's enrolment in the Program shall continue from the date of acceptance of these Terms and Conditions unlessterminated by either Seller or Pezkart, as provided below.
  2. Pezkart shall have the right to forthwith terminate the Seller's enrollment or participation under the Program at any point of time, with or without cause, in its sole and absolute discretion.

    The Seller may terminate the enrollment under the Program by providing 1 month's prior written notice to Pezkart.

  3. Pezkart reserves the right to terminate the Seller's enrollment under the Program in the event Pezkart determines, in its sole andabsolute discretion, that the Seller has contravened any provision of the Program or the Business Solutions Agreement (even if such breach does not lead to termination of the Business Solutions Agreement).
  4. The Seller acknowledges and agrees that at any point of time, Pezkart reserves the right to cancel, modify, change, suspend or withdrawany of the terms and conditions of the Program (including benefits under the Program) as it may deem fit, in part or in their entirety, with or without cause, without giving any prior notice without incurring any liability whatsoever.

6. LIMITATION OF LIABILITY

Notwithstanding anything contained in these Terms and Conditions, Pezkart shall in no event be liable for any special, indirect, consequential or incidental damages (including but not limited to damages for loss of business profits, business interruption, loss of business information, and the like) arising out of these Terms and Conditions, any documents referenced in these Terms and Conditions, or any addenda or amendment hereto even if Pezkart had been advised of the possibility of such damages.

 

7. WAIVER

 

  1. Pezkart does not waive any right under these Terms and Conditions by failing to insist on compliance with any of the terms of these Terms and Conditions or by failing to exercise any right hereunder. Any waivers granted hereunder are effective only if recorded in a writing signed by the party granting such waiver.
  2. To the extent permissible under any applicable law, Pezkart waives and disclaims all responsibility and liability for any damages or losses arising out of any statute, contract or otherwise from or in connection with the Program or any program related activities and any benefits provided hereunder.

8. MISCELLANEOUS

 

  1. The entire relationship between Pezkart and the Seller is governed by these Terms and Conditions as well as the Business Solutions Agreement and Easy Ship Terms. In the event of any conflict in the provisions of the Business Solutions Agreement, Easy Ship Terms and these Terms and Conditions, these Terms and Conditions shall prevail.
  2. Except to the extent specified in these Terms and Conditions, all other terms of the Business Solutions Agreement and Easy Ship Terms shall continue to be applicable and nothing contained herein shall affect or alter in any manner whatsoever, the validity, enforceability and interpretation of the Business Solutions Agreement and Easy Ship Terms.
  3. These Terms and Conditions represents the entire arrangement between Pezkart and the Seller with respect to the participation of the seller in the Program and supersedes any previous or contemporaneous oral or written agreements, terms and any other communications between the parties regarding the said subject matter.

Payment Timelines

The credit of payments for the Pezkart specific orders fulfilled by the Seller will be 5 working days from the Couries of each such order.

SCHEDULE 4

PEZKART RETURN AND REFUND POLICIES

In the event there are any refunds or returns initiated by the customers on any of the orders which are on account of default by the Seller or a fault attributable to the Seller (including but not limited to instances wherein the subject product has expired, damaged, does not meet the quality standards or is not as per the product description/specifications), the Seller will be not be paid for such orders and will be charged a penalty of 20% of the referral fee.

  1. Your customer creates a return order: The return process is the same as before with only one addition. Now, at the time of creating a return order, your buyer will be able to select the mode of refund for their return. 

  2. You successfully receive the return products: As soon as the status changes to "Return Delivered" for your order, it moves to the "Ticket" tab. 

  3. Select the refund status: In the Refund tab, you have two options for your return order:

Processing: It means you have received the return parcel, and you'll soon process the refund amount. 

Completed: It means you have processed the refund amount, and it will reach your buyer within 7-10 business days.
